Terms of use

The agreement between Pencilwick and the people who use it. We’ve kept it as plain as we can. Nothing here limits your rights under the Australian Consumer Law.

1. Who this agreement is with

These terms are between [legal entity name and ABN to be confirmed] (“Pencilwick”, “we”) and the account holder.

  • If a student is under 18, their parent or carer accepts these terms for them and is responsible for the account, including any payments.
  • If a student uses Pencilwick through a school, the school’s agreement with us applies, and these terms apply to the student’s use as far as they are consistent with it.
  • Teachers using Pencilwick in their own right accept these terms for themselves.

2. Your account

  • Give us accurate information, including the student’s year level and age band, so Pencilwick can pitch learning and protections correctly.
  • Keep your password private. An account is for one person.
  • Students under 15 need a parent’s consent before using the tutor or uploading files, as explained in our privacy policy.

3. Using Pencilwick well

Please don’t:

  • harass, bully or threaten anyone, or use Pencilwick to create harmful content;
  • try to get around safety features, or trick the tutor into ignoring its rules;
  • upload material you don’t have the right to share, or other people’s personal information;
  • copy, scrape or resell Pencilwick’s content or use automated tools to access it;
  • interfere with Pencilwick’s security or other people’s accounts.

4. Schoolwork and honesty

Pencilwick is for learning. Follow your school’s rules on using AI for assessed work. Teachers can turn the tutor’s full solutions off for a task and can export tutor conversations for set work. Pencilwick does not offer AI detection and makes no claim to detect AI use.

5. What the AI can and can’t do

  • The tutor and teacher tools use AI models. They can make mistakes. In maths, answers and working are checked by a separate maths engine, and Pencilwick tells you when a step couldn’t be checked. Other subjects aren’t checked in the same way.
  • Pencilwick is not a substitute for a teacher, and it is not medical, psychological, legal or financial advice.
  • If you or someone else is in danger, call 000. For support, call Kids Helpline on 1800 55 1800, Lifeline on 13 11 14 or 13YARN on 13 92 76.

6. Plans, prices and payment

  • Prices are in Australian dollars and include GST. We don’t charge card surcharges.
  • Paid plans are billed in advance, monthly or yearly, and renew automatically until cancelled.
  • We email you at least 7 days before a yearly plan renews, with the date and amount.
  • “Unlimited” features are subject to fair use: normal study, however heavy, is fine. If an account appears to be automated or shared, we’ll contact you before limiting it.
  • We’ll give at least 30 days’ notice of a price increase, and you can cancel before it applies. Founding families who join during early access keep their price for as long as their subscription continues.

7. Cancelling and refunds

  • You can cancel at any time by emailing us from your account address; we’ll process it the same day. There is no in-app cancel button yet. Your plan continues until the end of the period you’ve paid for.
  • Placeholder Refunds: if you cancel a yearly plan within 14 days of payment, we refund it in full. After that, we refund unused full months pro rata. [Final refund policy to be confirmed before launch.]
  • Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits them.

8. The free plan

The free plan’s daily limits may change. We won’t move a feature that free users rely on behind a paywall without at least 30 days’ notice.

9. Your content

You own what you create and upload. You give us permission to store, process and display it only so we can provide Pencilwick to you and to the people you share it with, such as a parent or teacher. We don’t use your content to train AI models. You can delete your content at any time.

10. Our content and the curriculum

Pencilwick’s lessons, practice generators, design and software belong to us or our licensors. You may use them for personal or classroom learning.

Teachers may use, adapt and share resources they generate with Pencilwick for teaching.

11. Schools

Where a school buys a licence, our agreement and data processing agreement with the school take priority over these terms if they conflict.

12. Suspending or closing accounts

We may suspend or close an account that seriously or repeatedly breaks these terms, or where needed to protect someone’s safety. We’ll tell you why, unless doing so would put someone at risk. If we close a paid account without good reason, we’ll refund the unused part. You can close your account at any time.

13. Responsibility for loss

[Legal review required, including for unfair contract terms.] To the extent the law allows, and apart from the consumer guarantees you can’t lose, our liability for any claim is limited to supplying the service again or refunding what you paid us in the 12 months before the claim.

14. Changes to these terms

We’ll email you at least 30 days before a material change. If you don’t accept it, you can cancel before it takes effect and we’ll refund any unused part of a paid plan.

15. Law and contact

These terms are governed by the law of [state or territory to be confirmed], Australia.
